END USER LICENSE AGREEMENT (EULA)

VERSION: 2026-02 IMPORTANT: PLEASE READ THIS LICENSE CAREFULLY BEFORE INSTALLING OR USING THE SOFTWARE.

1. ACCEPTANCE OF TERMS

By downloading, installing, or using the SOFTWARE, you agree to be bound by the terms of this LICENSE.

For Headless/Server Installations: You agree that by creating a specific acceptance file (e.g., /etc/hive/eula.txt) containing the required version string (e.g., accepted_license_version=2026-02) as directed by the SOFTWARE's documentation or error messages, you manifest your affirmative agreement to be bound by these terms.

2. DEFINITIONS

2.1 "ENDION" refers to Endion AG, the licensor of the software.

2.2 "SOFTWARE" refers collectively to the "Client Application" and the "Replication Server," including all executable files, cryptographic libraries, and associated documentation.

2.3 "CLIENT APPLICATION" refers to the software component used to mount cloud drives, manage files, and access the Endion Hive storage swarm.

2.4 "REPLICATION SERVER" refers to the server-side software component designed primarily to store, retrieve, and replicate encrypted blocks within a swarm without mounting a user-accessible filesystem.

2.5 "LOGICAL SWARM" refers to a specific network of interconnected SOFTWARE nodes configured to authenticate, communicate, and replicate data among themselves.

2.6 "SERVICE" refers to the peer-to-peer and hybrid storage network created by the interaction of instances of the SOFTWARE.

2.7 "CERTIFICATE" refers to the digital cryptographic certificate issued by ENDION’s central authority, required for the SOFTWARE to authenticate nodes.

3. GRANT OF LICENSE

Subject to your continuous compliance with this LICENSE, ENDION grants you a revocable, non-exclusive, non-transferable license to use the SOFTWARE under the following distinct terms:

3.1 Personal and Small Network Use (Free Tier) You may install and use the SOFTWARE on a maximum of eight (8) devices (nodes) within a single internal network or LOGICAL SWARM per organization or administrative domain, without charge. This usage is permitted for personal use, non-commercial testing, or internal business evaluation.

3.2 Commercial and Extended Use (Paid Tier) For use on more than eight (8) devices, or for specific commercial deployments as defined in a separate Sales Agreement, you must purchase a renewable commercial license from ENDION.

3.3 Enforcement & License Validation You acknowledge that the SOFTWARE monitors the number of active peers within your LOGICAL SWARM to ensure compliance with these limits. To validate and automatically renew commercial licenses, the SOFTWARE may transmit your Node ID and a License Key UUID to ENDION. ENDION uses this data exclusively to verify your purchased seat count against your subscription. ENDION does not collect user files, swarm traffic, or general behavioral telemetry. Exceeding the licensed node limit will result in the SOFTWARE restricting functionality to the Free Tier limits or rendering the SOFTWARE inoperable.

4. IDENTITY ISSUANCE

4.1 ENDION issues digital signatures used to establish username uniqueness within the SERVICE at the time of registration. These identity records are versioned and validated by SOFTWARE instances using embedded public verification keys.

4.2 ENDION does not operate a real-time account management or content control system and does not monitor or manage user data stored within the SERVICE.

5. SERVICE DEPENDENCY ON ENDION INFRASTRUCTURE

5.1 The continued operation of the SOFTWARE and the SERVICE depends on ENDION’s CERTIFICATE issuance and validation infrastructure. The SOFTWARE requires periodic renewal of CERTIFICATES issued by ENDION in order to function securely.

5.2 If ENDION discontinues operation of its certificate infrastructure, or if the SOFTWARE is unable to renew its CERTIFICATE, the SOFTWARE and/or the SERVICE may become partially or fully inoperable after certificate expiration.

5.3 ENDION does not guarantee perpetual availability of certificate services or indefinite operation of the SERVICE. To the extent permitted by applicable law, ENDION shall not be liable for data unavailability resulting from expired certificates or connection failures.

6. DATA SECURITY, PASSWORDS & RECOVERY

6.1 No Password or Access Key Recovery Any authentication for user accounts or cloud drives is handled exclusively by the SOFTWARE and not by ENDION. ENDION does not store your passwords, access keys, or seed phrases. We cannot recover or reset lost passwords or keys.

6.2 Irreversible Data Loss Due to the encryption methods used, failure to safeguard your passwords, access keys, and second-factor authentication will lead to the irreversible loss of access to your data. ENDION has no access to, and cannot assist in regaining access to any account or data for which you have lost the credentials.

6.3 Not a Backup Solution You understand and accept that the SERVICE is a swarm storage solution and not a guaranteed backup service . ENDION does not guarantee the correct storage, possibility of retrieval, accessibility, transfer speed, including in cases of peer unavailability, network partition, or swarm fragmentation of any file or data submitted to the swarm. You are solely responsible for maintaining independent backups of your data.

7. COPYRIGHT & CONTENT LIABILITY

7.1 User Responsibility The SOFTWARE is designed to store and replicate data. You are solely responsible for the data you submit to the SERVICE.

7.2 Copyright Compliance

You may only upload, store, replicate, or make available content for which you have all necessary rights, licenses, and permissions. You are solely responsible for ensuring that your use of the SOFTWARE and the SERVICE does not infringe any intellectual property rights or other rights of third parties.

ENDION does not monitor or control user content. Violation of this section may result in termination of your license to use the SOFTWARE at ENDION’s discretion. ENDION has no obligation to monitor, review, or proactively enforce compliance with this section.

7.3 Replication Server Content If you operate a REPLICATION SERVER, you understand that your device will store encrypted fragments of data submitted by other users. You acknowledge that you have no access to the content of these encrypted blocks and you are not deemed the publisher or originator of such encrypted data solely by virtue of operating a REPLICATION SERVER.

8. LICENSE RESTRICTIONS

You agree that you will NOT :

8.1 Reverse engineer, decompile, or disassemble the SOFTWARE or attempt to derive the source code, except to the extent permitted by applicable law.

8.2 Separate the components of the SOFTWARE for the purpose of redistribution.

8.3 Sell, rent, lease, or sub-license the SOFTWARE or access to the SERVICE to third parties without prior written consent from ENDION.

8.4 Use the SOFTWARE to store or distribute content that is illegal under the laws of Switzerland or your local jurisdiction.

9. EXPORT CONTROLS

The SOFTWARE is subject to the export control laws of Switzerland (Goods Control Act) and potentially other jurisdictions. You agree not to export, re-export, or transfer the SOFTWARE to any country or individual subject to Swiss, EU, or US sanctions or embargoes.

10. SOFTWARE UPDATES & COMPATIBILITY

10.1 Updates: ENDION may deploy or provide patches, updates, and modifications to the SOFTWARE that must be installed for you to continue using the SOFTWARE or the SERVICE.

10.2 Mandatory Protocol Changes: You acknowledge that the SERVICE relies on a shared communication protocol. ENDION may occasionally update this protocol to improve security, performance, or features. These updates are mandatory .

10.3 Functional Obsolescence: If you choose not to update the SOFTWARE, or if you disable automatic updates, you acknowledge that your version of the SOFTWARE may become incompatible with the rest of the swarm, rendering it effectively non-functional. ENDION is not responsible for any loss of service or data accessibility resulting from the use of outdated SOFTWARE versions.

11. CHANGES TO THE LICENSE

ENDION may modify this LICENSE in connection with new versions of the SOFTWARE. Updated LICENSE terms will apply only to the version of the SOFTWARE with which they are distributed. Continued use of a new version constitutes acceptance of the LICENSE applicable to that version.

12. DISCLAIMER OF WARRANTIES

THE SOFTWARE IS PROVIDED "AS IS" TO THE MAXIMUM APPLICABLE EXTENT OF THE LAW. ENDION DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

13. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ENDION BE LIABLE FOR ANY INCIDENTAL, INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING DAMAGES FOR LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THE USE OF OR INABILITY TO USE THE SOFTWARE OR THE SERVICES WHETHER BASED IN CONTRACT, TORT, OR OTHERWISE. ENDION WILL NOT INDEMNIFY ANY LOSSES CAUSED BY THE USE OR INABILITY TO USE THE SERVICES.

Exception: The limitations in this Section 13 shall not apply in cases of wilful misconduct or gross negligence by ENDION.

14. APPLICABLE LAW

This LICENSE shall be deemed to have been made in, and shall be construed pursuant to the laws of the Swiss Confederation . The exclusive jurisdiction for any disputes arising out of this LICENSE shall be the courts of the canton of Schwyz, Switzerland .

15. SUPERSEDING AGREEMENT

In the event of a separately negotiated written agreement with ENDION (such as a Commercial Sales Agreement or Enterprise License), that agreement shall prevail over this LICENSE with respect to the subject matter of such agreement.
